HOUSE CONCURRENT RESOLUTION NO. 22

Requesting the Joint Committee on Government Operations to make a study of the feasibility and effectiveness of crane safety equipment and the training, testing, licensing and certification of crane operators employed by or through state agencies.

Whereas, state agencies use or contract for the use of cranes in the performance of public duties; and
Whereas, The Legislature of West Virginia is greatly concerned with the safety of crane equipment used by or for state agencies, the safety of the operators of those cranes, the safety of other public or private employees working near such cranes, and the safety of the general public; and
Whereas, Various federal and state laws, rules and regulations affect the establishment of safety requirements for crane equipment and training or certification procedures for crane operators; and
Whereas, The Legislature encourages the development and coordination of all applicable laws, rules and regulations so as to promote the safety and well-being of all state employees and the general public, as well as private contractors and operators; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government Operations is hereby requested to review, examine and study the feasibility and effectiveness of crane safety equipment, including boom extensions, safety devices designed to reduce injuries that result from contact with overhead power lines, proximity warning devices, insulated boom guards for the top and bottom of booms, insulated links between crane hooks and loads being lifted by the crane; the feasibility and effectiveness of developing procedures for the training, testing, licensing and certification of all persons who operate cranes in this state; to determine whether the utilization of such safety equipment and training, certification or licensing procedures may be effected by state agencies and private contractors working for or through state agencies without violating any other federal or state safety laws, rules or regulations; to determine whether there is a need for equipment safety standards and training, licensure or certification for crane operators in this state; and to make recommendations to the Legislature regarding the same; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 1998, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
